A Chesterland man has been charged with vehicular homicide after his truck struck and killed a 22-month-old boy on September 25.

Police said a woman was pushing her son Troyonn Berger in a stroller when 44-year-old Daniel Fortney went off the road in his utility truck and into the driveway of an apartment on the 1900 block of Green Road.

The truck hit both the child and the woman before hitting a tree on the opposite side of the road.

The mother was taken to University Hospitals in critical condition at the time of the incident. The baby died from his injuries.

Fortney stopped and waited for police to arrive. At the time, police did not think he was under the influence of any substance.

Fortney is due in court on Nov. 8.
