Prosecutor clarifies future of three E. Cle. men

Cuyahoga County Prosecutor Michael O'Malley insists that he will not seek to retry the three East Cleveland men whose murder case was dismissed last summer

O'Malley offered to clarify a hearing in the case that will be held on Monday. 

O'Malley is standing by the agreement that was reached between prosecutors and defense attorneys last August.

At that time the case was dismissed without prejudice, which leaves open the possibility of charges being refiled. While O'Malley's office has no intentions of refiling the charges, he argues the wording in the agreement reached should not be changed.

O'Malley says his office has even gone so far as to offer defense attorneys the opportunity to expunge the charges entirely.

The convictions against Eugene Johnson, Derrick Wheatt and Laurese Glover were overturned in 2015 after spending nearly 20 years in prison.

Last summer, previous Cuyahoga County Prosecutor Timothy McGinty agreed to have the case dismissed rather than re-try the men.
