Springfield Township police say the officer involved in Jordn Miller's death last year did not violate Ohio statutes in his use of a Taser.
Police say also they are confident that the use of the Taser did not cause Miller's death.
Officers responded to Milowhite Drive on Sept. 8 after someone reported that the 24-year-old was running around naked.
Police found him one street over in an SUV, acting "delirious" with clothes on.
When police tried to get him out of the vehicle, he allegedly bit one of the officers in the calf. They were able to handcuff him but he continued to struggle.
That's when an officer used a Taser on Miller twice, both times for five seconds, according to notes from the Summit County Medical Examiner's Office.
Officers aided Miller, who was breathing and had a pulse, but stopped breathing just before EMS arrived on the scene.
He was taken to Summa Akron City Hospital where he was pronounced dead on September 10.
Police said they came to their conclusion about use of force following investigations from the Summit County Medical Examiner's Office and Summit County Prosecutor's Office.
At the time of his death police said the investigation revealed Miller had abused several drugs over the course of three days and hadn't slept in as many days. Police believed the drug abuse is what led to his bizarre behavior.
However, Miller's stepfather, Dale Tomblin, said Miller was suffering from food poisoning and heat stroke and the illness led to his actions that day.
